1. The parties
This agreement is between the undersigned visitor (“I” / “Visitor”) and Run-a-Muck Farms, including Daniel Crawford (operator), Michael and Amy Shealer (landowners), and all employees, volunteers, agents, and contractors (together, “Released Parties”).
2. What I'm doing here
I am visiting for one or more of the following: walking trails, farm tours, watching or participating in farm activities, and shopping at the farm stand (each an “Agritourism Activity”).
3. Pennsylvania law agreement and warning
Required verbatim under 3 Pa.C.S. § 4605. Read carefully.
AGREEMENT AND WARNING: I understand and acknowledge that, except for limited circumstances listed below, an agritourism activity provider is not liable for any injury to or death of a participant resulting from an agritourism activity. I understand that I have accepted all risk of injury, death, property damage and other loss that may result from an agritourism activity. I understand that an agritourism activity provider is not protected from liability if the provider: (1) Performs an act in a grossly negligent manner and causes injury or damages to a participant. (2) Purposefully causes a participant’s injury. (3) Acts or fails to act in a way that constitutes criminal conduct. (4) Recklessly fails to warn or guard against a dangerous condition that causes injury or damages to a participant. A dangerous condition is a condition that creates an imminent and substantial risk of injury or damages to a participant.
4. Risks I accept
This is a working farm. I understand and accept the risks of:
- Uneven ground, slippery paths, slips, trips, and falls
- Cuts from shears, snips, knives, and other picking tools
- Insect stings and bites, including bees, wasps, hornets, and ticks (Lyme disease risk)
- Contact with plants that cause rash, sting, or allergic reaction, including poison ivy, nettles, and pollen
- Weather exposure: heat, sun, rain, lightning, cold, wind
- The presence of the farm dog and any livestock on site
- Tractors, trailers, hand tools, and other agricultural equipment
- Dust, pollen, mold, and other airborne particulates
- Industrial fiber hemp plants grown on the property (legal under PA hemp program; no cannabis products in the fields)
- Ponds, water features, hose bibs, and wet surfaces
- Other inherent risks of a farm environment
5. My responsibilities
I agree to:
- Follow all posted signs and staff instructions
- Stay on marked paths and within open areas
- Keep children in my party under direct supervision at all times
- Use tools only as shown by staff and only for their intended purpose
- Not climb fences, structures, trees, or equipment
- Not consume anything grown on the farm unless offered or purchased
- Report any injury, hazard, or concern to staff immediately
6. Release and indemnity
To the fullest extent allowed by law, I release the Released Parties from any and all claims, damages, and demands arising from my visit, including those caused by the Released Parties' ordinary negligence. I agree to indemnify and hold harmless the Released Parties from claims brought by me or on behalf of anyone in my party, except as limited by the exceptions in Section 3 above.
7. Minors in my party
If anyone under 18 is in my party, I am their parent or legal guardian. I sign on my own behalf and, to the extent permitted by Pennsylvania law, on behalf of each minor. I understand Pennsylvania law may not permit me to waive a minor's own independent claim, and I accept personal responsibility for supervising each minor in my party.
9. Governing law and venue
This agreement is governed by Pennsylvania law. Any dispute will be filed in the Court of Common Pleas of York County, Pennsylvania.
10. Severability
If any part of this agreement is held unenforceable, the remaining parts stay in full force and effect.
